GENERAL TERMS AND CONDITIONS * * * 1. General information: The following terms and conditions apply to all orders placed on this website with ¡HOLA! Mallorca, managed by Philip Bornewasser ESY4375483T, hereinafter referred to as "¡HOLA! Mallorca". Other terms and conditions shall not form part of the contract, even if we do not expressly object to them. Any terms and conditions that deviate from these terms and conditions shall only apply if they have been confirmed by us in writing. * 2. contracting parties, conclusion of contract: Your service contract is with ¡HOLA! Mallorca. You can order our services by filling in the online form or by placing an order by telephone or email. By clicking on the order button you place a binding order. Confirmation of receipt of your order will be sent to you by email after you have submitted your order. As part of our service, we will check the forms submitted for formal completeness in accordance with the requirements of the relevant Spanish authority. The decision to approve your application is at the sole discretion of the Spanish authorities. ¡HOLA! Mallorca cannot guarantee the issue of a tax number or residencia. We also reserve the right to pass on all or part of your application to a third party. We also reserve the right to refuse any application. In this case we will notify you. We will accept your application by sending you a confirmation of acceptance in a separate email or by sending you the necessary forms within two days. * 3. payment: Payment is due when the order is placed. This is to be settled when the invoice is sent. We reserve the right not to print the advertisement until full payment has been received. The following payment methods are available: 1. bank transfer: We will send you our IBAN bank details in Spain in a separate email. This way you can easily make a bank transfer. * 2. cash payment on collection: You pay the invoice amount in cash at the time of collection. * 3. paypal: We will send you the necessary payment information so that you can conveniently pay online. * 4. duty to co-operate: You agree to provide any missing or incomplete documents and to cooperate in the processing of your application. If, despite repeated requests, you fail to contact us with incomplete forms, your documents will be returned to you by the cheapest postal method. ¡HOLA! Mallorca will not be responsible for any loss or damage that may occur during the sending of the documents. * 5. processing times: We will do our best to process your order as quickly as possible. It is the sole responsibility of ¡HOLA! Mallorca to send the documents and forms on time. However, delays are sometimes unavoidable. We will try to meet the deadlines you set. However, they are not legally binding on us. The decision to carry out the service (e.g. issuing the NIE number, etc.) is made by the relevant authority in Spain. Unfortunately, we have no control over this. We also expressly accept no liability or guarantee for the observance of any deadlines, regardless of their importance to you or your order. * 6.1 Compensation in the event of non-performance: In the event that documents sent to ¡HOLA! Mallorca are lost or damaged, our liability is limited to €100 per applicant. If the completed documents are lost or damaged on their way to the applicant, ¡HOLA! Mallorca will be liable for the exact amount received by you as compensation from the courier service. As a gesture of goodwill and without acknowledging any legal obligation, we are prepared to reimburse part of the replacement cost up to a maximum of €100. * 7. data protection: With the establishment of the business relationship, your data, which may also be personal, will be stored internally and processed manually or in an automated process as required for the execution of the contract. The data will only be transferred to third parties for the purpose of executing the order if this is necessary. ¡HOLA! Jurisdiction: The applicable law is Spanish and the place of jurisdiction is Palma de Mallorca, Spain. * 9. We are willing to participate in an out-of-court dispute resolution procedure before a Consumer Arbitration Board.
